This policy explains how we collect, use, protect, and disclose information across ESLvideo.com, related websites, subdomains, applications, the Neo English app, and related services.

• This policy applies to all ESLvideo services and tools.
• It explains what information we collect and how it is used.
• California residents may have additional rights under applicable law.
• ESLvideo is designed for adult and secondary school learners. It is not directed to children under 13.

Registration, support, and purchases

We collect information you provide directly when you create an account, contact support, or make a purchase.

• Account information may include name, email address, username, password, city, and time zone.
• Support requests may include the contents of your message.
• Payments are processed by Stripe. We do not collect or store credit card information.

How student privacy is protected

Student privacy is a top priority. We design Chattybots so students can participate without creating personal accounts.

• Students can use Chattybots free or with a Class Code and Chattypass. No email or personal account is required.
• Students may use a first name or nickname.
• Audio is processed in real time for transcription and is not stored.
• By default, transcripts and scores are not saved.
• When a teacher enables transcript reporting, transcripts may be stored securely and linked only to a name or nickname and a Class Code.
• Stored transcripts are deleted after 365 days or when the Class Code is deleted.
• If a student chooses a native language, we use that choice to write feedback in that language.
• Teachers can add ESLvideo activities to Canvas by importing a QTI or Common Cartridge file. ESLvideo does not receive any student information from Canvas.

Schools and student records

When a teacher or school uses ESLvideo with students, the teacher or school controls whether transcripts are saved and when they are deleted.

• We use student information only to provide the service to that teacher or school.
• We do not use student information for advertising, and we do not build profiles of students for any purpose other than their learning.
• For schools in the United States, we act as a service provider to the school, in the role FERPA calls a "school official." Student records remain under the school's control.
• A student, or a parent of a student under 18, who wants to see, correct, or delete a student's information should ask the teacher or school, and we will help the school respond.
• Schools that need a signed data privacy agreement can contact us at support@eslvideo.com.

How speaking activities are processed

We use third-party services to process speech and generate responses. These services are used to run the activity, not to train AI models.

• Deepgram processes speech-to-text and discards audio after processing.
• OpenAI generates responses and may retain API data for up to 30 days.
• AWS Polly turns the bot's replies into voice. It does not receive student audio.
• Heroku (Salesforce) runs our scoring services, which produce scores and feedback.
• SiteGround hosts our website and database.
• What students say in Chattybot conversations is not used to train AI models.
• We send these providers only what they need to run the activity. Deepgram and OpenAI, which process what students say, may not use it to train their AI models under our settings and their terms.

Logs, cookies, and usage

We collect limited technical information to operate and improve the service.

• Server logs may include IP address, browser type, and pages visited.
• Cookies may be used to maintain sessions and improve functionality.
• We do not use Google Ads or advertising profiling.
• Third-party links and tools follow their own privacy practices.
• We use Google Analytics to measure how the site is used.
• We do not sell or rent personal information, and we do not share it for advertising.

How information is protected

These safeguards apply to the information described in this policy.

• Information is encrypted in transit between your device, ESLvideo, and our service providers.
• Access to stored data is limited to ESLvideo staff and contractors who need it to operate and support the service.
• If we learn of a security incident that affects personal information, we will notify the affected teachers and schools without undue delay and as required by law.

Deleting your data

You can delete information yourself or ask us to do it.

• Teachers can delete a Class Code at any time, which deletes the transcripts stored under it.
• Stored transcripts are otherwise deleted after 365 days.
• To delete an account, or to ask us to delete or send you a copy of the information we hold about you, email support@eslvideo.com. We respond within 30 days.

Outside the United States

ESLvideo is operated from the United States, and information is processed in the United States by us and our service providers.

• If you use ESLvideo from another country, your information will be transferred to the United States.
• Depending on where you live, you may have the right to access, correct, or delete your personal information, or to object to how it is used. To use these rights, contact support@eslvideo.com.
• Schools outside the United States that need a data processing agreement can contact us at support@eslvideo.com.

Service and optional emails

We send only the emails needed to run the service, along with optional updates if you choose to receive them.

• You may receive optional updates about new features or content.
• You can unsubscribe from optional emails at any time.
• We may still send required service emails related to your account or activity.

Your content and responsibilities

You retain ownership of your content. By using the service, you grant us permission to process and display it as needed to operate the platform.

• You are responsible for the content you upload or share.
• You must have the rights to use and share your content.
• You may not use the service for illegal, harmful, or abusive purposes.

Service terms and limitations

Use of the service is subject to standard legal terms.

• We may suspend or terminate access to the service.
• The service is provided as-is without warranties.
• Liability is limited as described in this policy.
